1. Independent Contractors

All contractors introduced or engaged through Hervey Bay Fencing are independent entities and are not employees, agents, partners or representatives of Trektech Holdings Pty Ltd.

Trektech Holdings Pty Ltd does not supervise, direct or control the work performed by these contractors. Independent contractors are responsible for their own quotations, pricing, contracts, licences, insurance, materials, employees and subcontractors, workmanship, warranties, timeframes, regulatory compliance and completion of work.

2. Quotes, Contracts and Payments

Any quotation provided by a contractor, agreement or contract entered into, work authorised, deposit paid or other payment made is an arrangement directly between you and the independent contractor.

Trektech Holdings Pty Ltd is not a party to any agreement or contract between you and an independent contractor and does not receive, hold or process deposits or other payments on behalf of independent contractors.

You are responsible for reviewing and accepting a contractor's quotation, payment terms and any other conditions before engaging the contractor, authorising work or making any payment.

3. No Liability for Independent Contractors

To the extent permitted by law, Trektech Holdings Pty Ltd expressly disclaims liability for the actions, omissions, conduct or performance of independent contractors.

Any agreements, contracts or transactions entered into between you and any contractor are strictly between you and the contractor. Trektech Holdings Pty Ltd shall not be liable for any claims, losses, damages or costs arising from or in connection with those arrangements.

This includes, without limitation, claims or losses arising from:

• deposits or other payments made directly to a contractor;
• failure by a contractor to commence or complete work;
• delays or abandonment of work;
• defective, incomplete or unsatisfactory workmanship;
• failure to honour warranties or rectify work;
• property damage;
• representations or statements made by a contractor;
• a contractor's failure to comply with applicable licensing, insurance, regulatory or legal requirements;
• disputes between you and a contractor; or
• the loss, retention or misuse of money paid directly to a contractor.

Trektech Holdings Pty Ltd does not guarantee that an independent contractor will commence or complete work, meet agreed timeframes, perform work to a particular standard or fulfil their contractual or financial obligations to you.

4. Contractor Referrals and Customer Due Diligence

The introduction or referral of an independent contractor through Hervey Bay Fencing does not constitute a guarantee, endorsement or warranty by Trektech Holdings Pty Ltd regarding that contractor's workmanship, conduct, reliability, financial position or suitability for a particular project.

You are responsible for conducting your own due diligence before engaging a contractor or making any payment.

This may include satisfying yourself as to the contractor's identity, business details, qualifications, licences, insurance, experience, reputation, quotation, payment terms and suitability for the work you require.

5. Assumption of Risk

You acknowledge and assume the risks associated with engaging an independent contractor, including risks relating to the quality and completion of work, safety, legal and regulatory compliance, contractual disputes and payments made directly to contractors.

It is your responsibility to determine whether an independent contractor is suitable before accepting a quotation, entering into an agreement, authorising work or making a deposit or other payment.

6. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Trektech Holdings Pty Ltd, its officers, agents and employees from claims, liabilities, damages or expenses, including reasonable legal costs, arising out of or related to your engagement of or dealings with an independent contractor introduced through Hervey Bay Fencing.

7. Australian Consumer Law

Nothing in this disclaimer is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or any other applicable legislation.

8. Website Identity

This website is independently operated and is not affiliated with, endorsed by, or associated with any other business that may trade under a similar or identical name.
